1. A booking is accepted on receipt by us with 50% payment of total holiday cost per person. We will send a funds received confirmation email.

2) Prices are payable as quoted. For payments with Credit Card or via Paypal a 3% surcharge must be added.

3) E.A.T. PTY Ltd. reserves the right to alter any prices at any time before your holiday is accepted. If at the time of booking the price is different to that shown on our website you will be advised of the revised price applicable before the booking is accepted.

4) E.A.T. PTY Ltd. accepts no responsibility for loss or damage to baggage or possessions while in transit with us or our partners. If a client becomes ill, all hospital expenses, doctors fees and repatriation costs are the responsibility of the client and E.A.T PTY Ltd. shall not be liable to refund any part of the tour cost. It is the clients responsibility to have adequate insurance with a reputable insurer to cover personal injury, medical expenses, repatriation expenses, loss or damage of luggage and its contents and expenses associated with cancellation or curtailment.

5) For all bookings a 25 % deposit is required within 14 days of making a reservation. Please note that a reservation is not confirmed nor secured until this deposit has been paid. We reserve the right to release any accommodation being held where this required deposit has not been received within the stated period.

6) The balance of the accommodation charges and the costs of all transfers must be paid in advance, no later than 35 days prior to a guest’s arrival. We reserve the right to cancel any booking should payment not be received in full. If a booking is made within 30 days prior to arrival, full payment will be required at the time of booking.

7) All extra charges incurred during a guest’s stay must be settled at the lodge on departure.

8) Please note that flight transfer costs are included in the definition of bookings for the purposes of this agreement and our cancellation policy.

9) Cancellation Policy: Cancellations by you must always be made in writing and are applicable only on the day received by us. The following cancellation terms apply:

10) Day Tours: Free cancellation up to 48hours before travel date. After 48hours 100% cancellation fee.

10.1) Multi day Tours: Up to 31 days prior to holiday start date 7 % cancellation fee.

11) 15 to 30 days prior to holiday start date refund of 50%.

12) For cancellations less than 15 days prior to travel date no refund.

If a hotel grants a refund we will pass it on.  Any refunds will be made by PayPal or international bank transfer in Euro or USD. All money transfer charges will be for your account. If we are forced to cancel your booking, we shall offer either an alternative at similar cost or a full refund, but we cant be held  liable for any other expenses which you may have incurred as a result of the booking.

13) We cannot accept liability or pay compensation where the contract (booking) is affected by ‘force majeure’ or Act of God. In the context of these terms and conditions ‘force majeure’ or “Acts of God” is any event that we could not, even with due care, foresee or avoid. These events include but are not limited to war, threat of war, flood, explosion, sabotage, riot, civil commotion or strife, hostilities, industrial dispute, natural disaster, fire, terrorist activity, nuclear disaster, adverse weather, government action, technical problems with transportation or any other event outside our control.

14) If you need to make alterations to your holiday after your deposit has been received and accepted by E.A.T. PTY Ltd we shall do our utmost to help; however alterations within 29 days of departure may be treated as a cancellation and re-booking.

15) We do our utmost to ensure you have an enjoyable holiday. If you have any problems please contact us or our partners immediately and we shall do our best to resolve them. Any complaints should be notified to us as soon as reasonably possible and in any event notified to our office by SMS or email at the end of your holiday.

16) The information contained in our website is to the best of our knowledge correct, but all information is subject to alteration without notice. We accept no liability for any inaccuracy in the information provided.

17) If the actions of you or your party cause damage or injury to accommodation or property of a third party or to any person you agree to indemnify us against any claim (including legal costs) made against us by or on behalf of the owners of such accommodation or property or person arising from any accident.

18) E.A.T. PTY Ltd. cannot be held responsible for the conditions of the walking paths or terrain included in our tours or for the actions of other users of such routes. Therefore at all times you participate in our tour at your own risk. We will not be responsible for death, injury, or illness of customers on our holidays howsoever caused.

These conditions and any contract to which they apply are governed in all respects by the laws of the Republic of South Africa. Each party irrevocably submits to and accepts, generally and unconditionally, the non-exclusive jurisdiction of the Cape Town High Court of South Africa, or any other division of such court that may have jurisdiction, with respect to any legal action or proceedings that may be brought at any time.
